The following Terms and Conditions apply to the booking made by the client (“you”) of the services of Claire Lau Photography (“we” and “us”).  Paragraph 1 applies only to wedding bookings.  The remaining paragraphs apply to all bookings.  

1. T&Cs applicable only to wedding bookings:

   (a) A non-refundable deposit of 50% is payable by you upon booking.  Reservation of your date is not guaranteed until the deposit has been paid. 

   (b) The balance of the fee is due from you no later than two weeks before the wedding.

   (c) No part of the deposit or balance paid will be refundable in the event that you cancel our services. 

   (d) The planning session and engagement mini-shoot shall be held on a weekday.

2. The post-processed images will be provided to you in digital form only.  We will not provide any physical prints.

3. We have full control over all artistic decisions made in relation to the photographs.  

4. We will use all reasonable endeavours to retain the photographs for a minimum period of 12 months from first supplying them to you, and you may contact us during this period to ask that the photographs be made available to you again for downloading.  Please ensure that you keep your own back-up copies of your photographs.  After this 12 month period, we are under no obligation to retain the photographs or make them available to you again.  

5. Insofar as permitted by law we exclude liability for any damage to property or injury to the person that might occur during a photoshoot or wedding whether by our act or omission or otherwise.   All activities during the photoshoot or wedding are undertaken at your own risk.  We assume no duty of care towards you.  Your safety and that of other participants in the photoshoot or wedding is your responsibility at all times.  It is your responsibility to supervise and to attend to your children to ensure their safety at all times.  All children must be accompanied by a parent or guardian at all times. 

6. Copyright in all images is retained worldwide by us at all times and nothing shall be deemed as a release, transfer, assignment or other disposal of our rights in the images.

7. You are granted a licence to use the images for personal use including to copy, share, upload and print the images.  The licence does not permit you to sell the images or to use the images for any commercial use or monetary gain.

8. We have the right to use the images as part of the Claire Lau Photography portfolio.  You consent to us using your photos on our website(s), social media pages, and all other forms of advertising and marketing materials (whether digital or paper or otherwise), as well as for submission to competitions and awards.

9. In the highly unlikely event of a cancellation by us, or unavoidable inability to attend in whole or in part, or equipment failure, or any other failure to deliver photographic coverage of your wedding or event or photoshoot, our liability shall be limited to a full refund of any booking fees paid.  There shall be no liability for non-pecuniary loss including damages for distress, inconvenience, hurt feelings or upset, loss of enjoyment or other such losses of this nature.
